California Signs First-of-Its-Kind Executive Order Requiring AI Safety Standards for State Contracts

SACRAMENTO, CA – March 30, 2026 – California Governor Gavin Newsom signed a first-of-its-kind executive order (N-5-26) requiring AI companies seeking to do business with the state to demonstrate responsible policies and meet rigorous safety and privacy standards. The order comes as the Trump administration rolls back federal AI protections, positioning California as a leader in responsible AI governance.
Key Provisions
The executive order directs the Government Operations Agency to develop new state contracting processes that vet AI companies based on their policies and safeguards in the following areas:
The order also enables the state to separate its procurement authorization process from the federal government's if needed.
AI-Generated Content Watermarking
The California Department of Technology (CDT) is directed to create recommendations and best practices for watermarking AI-generated images or manipulated video consistent with state law — the first such initiative nationwide.
AI for Government Services
Beyond regulation, the order commits to expanding California's use of GenAI to improve state services, including a new AI-directed tool to help Californians navigate available programs and benefits by life event, such as starting a business or finding a job.
Context and Significance
California is the world's 4th largest economy and home to major tech companies including NVIDIA, Google, Adobe, IBM, and Microsoft. Governor Newsom has been progressively strengthening AI policy since his September 2023 executive order (N-12-23) on safe generative AI use.
